Information on the tax deductibility of school and childcare costs

Subject to legal changes, the following tax deductions apply:

1. Tax deductibility of school expenses

In Germany, 30% of the costs incurred for school education can be claimed as special expenses for tax purposes. The maximum deductible amount is limited to €5,000 per year and child. School costs do not include costs for accommodation, meals, childcare, school books, etc.

The Kurpfalz boarding school determines the relevant share of school costs annually and certifies this at the beginning of the following calendar year.

2. Deductibility of boarding school fees

Parents with a child under the age of 14 can deduct so-called childcare costs as special expenses in addition to school costs. Two-thirds of childcare costs – up to a maximum of €4,000 per year and child – are deductible. The previous rule that both parents must be working was abolished on January 1, 2012.

The Kurpfalz boarding school determines the relevant share of care costs annually and certifies this together with the school costs at the beginning of the following calendar year.

3. Special case: giftedness

If gifted children suffer from underchallenge combined with behavioral problems at a normal school, attending a boarding school with a special focus may be necessary.

In this context, the ruling of the Federal Finance Court of May 12, 2011, Ref. VI R 37/10, is of interest to parents whose children are highly gifted. Among other things, it contains the following guiding principle:

Expenses incurred for attending a school for gifted children may be deductible as extraordinary expenses if attending the school was medically indicated.

4. Special case: “pathological” reading and spelling disorder

According to a ruling by the Federal Fiscal Court, in cases of “pathological” reading and spelling disorders or dyslexia, the costs of boarding school accommodation are also tax-deductible as extraordinary expenses (see BFH ruling of November 11, 2010, ref. VI R 17/09). One of the requirements for this is the submission of a corresponding expert opinion for medically necessary accommodation away from home.

Note: Please note that this information cannot and should not be legally binding, and that you should consult your tax advisor for further advice to be on the safe side.
